PingUp Privacy Policy

Pingup operates a service that enables users to submit appointment requests, make appointments, order food, and pay for various goods and services with local merchants (the “Merchants”) through an online or mobile publisher.  We also provide an online and mobile chatting experience through publisher “bot” applications for users to discover, book and buy available services and products from Merchants and to share information about Merchants, and a “booking button” service to Merchants (all together the “Services”). (“Pingup”, “we,” “our” or “us”) is committed to protecting the privacy of the personal information we collect from our users (“users,” “you” or “your”). This Privacy Policy describes how we collect, use, and disclose personal information.  This Policy applies to the Pingup website at (the “Website” or the “Site”), and all of its publisher subdomains (the “Publisher Sites”), and chat/bot applications (“Bots,” such as OrderNow). This Policy covers information we collect online, not offline.  The Site is owned and operated by Getabl, Inc., 11 Elkins St., Boston, MA 02127.

Any personally identifiable information collected by the Site shall be used in a manner consistent with this Privacy Policy.  By using or accessing any of the Services, you expressly agree to the use of your information for the purposes described in this Policy. If you do not agree with this Privacy Policy or any changes to it, you should not use or access our Website or Services.

Changes to Our Privacy Policy

Personal Information 

Personally Identifiable Information (“Personal Information”) is information about you that you provide to us that is personally identifying, such as your name, email address, location data, physical address, billing information or telephone number, and that is not otherwise publicly available. The definition of Personally Identifiable Information depends on your physical location (i.e., state of residence) and may include other types of information. Only the definition that applies to your physical location will apply to you under this Privacy Policy.

100% Opt-In

Providing Personal Information by accessing the Services is entirely voluntary and is by opt-in only.  You can opt-in by using any of our Services, or by emailing us for information.  If you do not opt-in you will not have access to our Services, and we will have no way of contacting you to respond to your inquiries or requests for information or appointments.  By opting in you are providing your express consent to the collection, use, retention, processing, transfer, and disclosure, including international disclosure, of your Personal Information as explained in this Privacy Policy.

What Personal Information Do We Collect?

When you make (or request) an appointment through our Site, we collect information such as your first and last name, telephone number, and email address.  If you order food or make a purchase, we also collect your delivery address (for food delivery) and payment card information, billing address and zip code.  We collect this information so we can provide you with the Service(s) you request and to process your transactions.  If you email us with a question, we collect your first name and email address in order to respond to you.

When you make an appointment, order food, and/or purchase goods and services through an iframe, your name, payment card information, billing address and phone number will be collected by a partner to service your request and process your transaction, and the partner will handle your information in accordance with the partner’s privacy policy.  If Pingup processes your payment on its own behalf or on behalf of a Merchant, we will collect your name, payment card information and billing address in order to provide the requested Services and process your transaction.   If the Merchant is the payment processor, we will also provide your payment card information and billing address to the Merchant so the Merchant can provide the requested Services and process your transaction.   Please note that this Privacy Policy only applies to user information collected by Pingup.

When you participate in a chat, we may collect the information you post.  Please note that information you post is public and may be viewed, collected, used or disclosed by others, is not private, and is not protected under this Privacy Policy.

When a Merchant subscribes to our booking button service, we collect Merchant name, business name, business website, email, mobile phone number, and payment card information and billing address.  We collect this information in order to provide the booking service and to process subscription payments.  When a Merchant makes a payment to subscribe to the booking service, payment information and information required to process subscription payments is also collected by our third party payment processor in order to process the transactions.

Consent to Text Messaging, Emails and Public Messaging

By providing your telephone number(s), including your mobile phone number, to us you expressly consent to receive marketing and non-marketing calls and text messages from Pingup, Merchants and others calling or texting on Pingup’s and Merchants’ behalf, including calls and text messages made with an autodialer or prerecorded voice, at the telephone number(s) that you provide.   By providing your email address you consent to receive email messages.  By using our Services, you consent to receive public messages.  Such calls, text messages, emails and public messages may include, for example, appointment information and reminders, authentication messages, account- or service-related alerts and reminders, customer service communications, satisfaction surveys, and other types of non-marketing and marketing calls, emails, public messages and text messages. You may opt-out of marketing communications at any time by emailing us at or by clicking “unsubscribe” at the bottom of emails you receive.

Do We Use Cookies or Other Technologies?

When you visit the Site or use the Services, we use “cookies” — a piece of information stored on your computer — to allow us to uniquely identify your browser while you are on any of our properties and to enable Pingup to provide the Services. We may link the information we store in cookies, such as your IP address, to the Personal Information you submit while on our Site.

Pingup uses persistent cookies that only Pingup can read and use, to identify you as a Pingup user and make it easier for you to use our Services. Users who disable their web browsers’ ability to accept cookies will be able to browse our Site, but will not be able to access or take advantage of the Services.

Our technology partners may use cookies to trace user movement on our Sited the publisher’s website and to collect usage data for the Services.  The use of cookies by our partners is not covered by our Privacy Policy. We do not have access to or control over cookies used by third parties.

We also use Internet robots, or “bots” to enable you to participate in chats, place food orders with our food Merchants, or make or request reservations and appointments.  This information is used to provide the requested Services and process your transactions. If you chat with bots, we collect the contents of your conversation (which may include Personal Information) to improve your experience and our Services or create new ones. 

How Do We Protect Your Information?

We will take reasonable precautions to protect Personal Information from loss, misuse, unauthorized access, disclosure, alteration and destruction.  We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it.  No method of transmission over the Internet, or method of electronic storage, is 100% secure, however.  Therefore, we cannot guarantee its absolute security.

We will retain Personal Information we process for as long as needed to provide the Services. We will retain and use this Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Choice and Consent

By emailing us or by opting-in to use the Site or access the Services you expressly consent to the collection, use, retention and disclosure of your information as described in this Privacy Policy.  Each time you email us or access any of the Services, you are giving your express consent to the collection, use, retention and disclosure of your information as described in this Privacy Policy.

Do We Disclose Personal Information to Third Parties?

When you provide information to make an appointment or book with a Merchant, order food or purchase goods and/or services from a Merchant, the information you provide will be disclosed to the Merchant and to our third party software providers that supports our Services.  The use of your information by the Merchant and the third party software provider is covered by that individual Merchant’s or third party software provider’s privacy policy and not by our privacy policy.  We urge you to review each Merchant’s and third party software provider privacy policy before making an appointment through Pingup.

If you are a Merchant that subscribes to the booking service, the information you provide will be disclosed to our third party payment processor to process your transaction.   We currently use Stripe to process payments. The use of your information by the third party payment processor is covered by their privacy policy and not by our privacy policy.  We urge you to review their privacy policy before completing your subscription and to review the privacy policy of any additional payment processors that may process a booking subscription in the future.

When you provide information to make an appointment, order food or purchase goods and/or services from a Merchant, your information will also be disclosed to an online or mobile publisher which they may use for their direct marketing purposes.  We refer to the online or mobile publisher as our “partner.”  The use of your information by our partners is covered by each individual partner’s privacy policy and not by our privacy policy.  We urge you to review each partner’s privacy policy before making an appointment, ordering food or purchasing a product/service through Pingup.

We do not sell, share or disclose your Personal Information to third parties other than third party vendors, Merchants and partners necessary to enable us to provide the Services and process your appointment or food order. By accessing our Site or the Services or by sending us email, you provide your express consent to our disclosure of your Personal Information to our Merchants, partners and third party vendors for the purposes described in this Privacy Policy.

We may also release your information when we believe release is appropriate to comply with the law, enforce our Site policies, or protect our or other’s rights, property, or safety. Because our servers, which store your information, are located in the U.S.A., your information may be available to U.S. government entities or agencies under a lawful court order in the U.S.

In some cases, Pingup may disclose data in aggregate form to selected third parties.  The information we disclose in such cases will not include Personal Information.

Third Party Sites and Links; Merchant Sites, Partner Sites and Links

Our Site may contain links to other websites that are independent, are not owned or operated by us, are not covered by this Privacy Policy and which may incorporate Third Party Information. These third party sites have separate and independent privacy policies.  If you access other sites using the links provided, including Merchant sites and partner sites, the operators of these sites may collect information from you which will be used by them in accordance with their privacy policy, which may differ from ours.  We therefore have no responsibility or liability for the content and activities of other websites, including Merchant websites and partner websites, even if they are linked to our Site.

International or Cross-Border Transfer of Your Personal Information and Your Express Agreement

The Site and Services are intended for U.S. residents only. Given that the Internet operates in a global environment and that, if you operate outside of the United States, transfer of your data is necessary for you to use our Services or request information from us, using the Internet to collect and process Personal Information necessarily involves the transmission of data on an international, or cross-border, basis.  By accessing the Services and/or by communicating with us by email, you acknowledge and expressly consent to our processing and disclosure of your Personal Information in this way.

For users who are located outside the United States, Personal Information will be transferred outside of the customer’s country to the United States where our servers are located and where it will be processed and stored on services owned and operated by Amazon AWS, which participates in the EU-US Privacy Shield program.  You may view the Amazon AWS privacy policy at  The U.S. does not provide an adequate level of protection according to EU data protection regulations, for the purpose of providing the Services.  We will take all steps reasonably necessary to ensure that Personal Information is treated securely and in accordance with this Privacy Policy in respect of such transfer, but will not otherwise take steps to ensure compliance with applicable laws in each customer’s country of residence. Your California Privacy Rights; California Do Not Track Disclosures

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us once a year, free of charge, information about the Personal Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year.

If applicable, this information would include a list of the categories of Personal Information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. Children’s Online Privacy Protection Act Compliance

We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act), as we do not knowingly collect any information from anyone under 13 years of age.  The Site and Services are directed to people who are at least 13 years old or older.

Business Transfers

In the event of a business transition such as a merger, acquisition by another company, or sale of all or a portion of Getabl’s assets, users’ information (including Personal Information) may be among the assets transferred. You acknowledge and consent that such transfers are permitted by this Privacy Policy, and that any acquirer of ours or that acquirer’s assets may continue to receive, store, transfer and process your information as set forth in this Privacy Policy.
